Q:    What is a Felony?


A:     Generally, at common law, crimes that are punishable by confinement of a year or more are felonies.


        In Texas however, there are 5 types of felony categories with different ranges of punishment:


  1. (1) Capital Felonies - punishable by life imprisonment or death


  1. (2) First Degree Felonies - punishable by life, or 5 - 99 years imprisonment


  1. (3) Second Degree Felonies - punishable by confinement of 2 - 20 years imprisonment


  1. (4) Third Degree Felonies - punishable by confinement of 2 - 10 years imprisonment


  1. (5) State Jail Felonies - punishable by confinement of 180 days to 2 years in state jail
